1. Acceptance of terms
These Terms of Service ("Terms") govern your access to and use of the AccessGov website, applications, and government technology platforms (collectively, the "Services"). By creating an account, accessing, or using the Services, you agree to be bound by these Terms and our Privacy Policy.
If you are using the Services on behalf of a government institution, public agency, or organisation, you represent that you have authority to bind that entity to these Terms.
2. Definitions
- "AccessGov" refers to the company operating these Services.
- "Services" means the websites, platforms, software, support, and related services provided by AccessGov.
- "User," "you," and "your" refer to any individual or entity accessing or using the Services.
- "Account" means a registered user account created to access parts of the Services.
- "Institution" means the government entity, ministry, agency, or public body associated with your use of the Services.
- "Content" means any information, data, text, documents, or materials submitted, uploaded, or generated through the Services.
3. Eligibility
The Services are intended for authorised users of government institutions, public agencies, and their approved partners. You must be at least 18 years old and have the legal capacity to enter into these Terms. AccessGov may refuse service, suspend accounts, or terminate access at any time, in its sole discretion.
4. Account registration and security
To use certain features of the Services, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorised use of your account or any other security breach. AccessGov is not liable for any loss or damage arising from your failure to protect your account information.
5. Acceptable use
You agree not to use the Services to:
- violate any applicable law, regulation, or governmental policy;
- infringe on the rights of others, including intellectual property, privacy, or confidentiality rights;
- transmit viruses, malware, or other harmful code;
- attempt to gain unauthorised access to systems, accounts, or data;
- interfere with the security, integrity, or performance of the Services;
- use the Services for fraudulent, deceptive, or misleading purposes;
- upload or share sensitive personal data beyond what is necessary for the intended use of the Services.
6. Services description
AccessGov provides digital platforms designed to help government institutions automate processes, manage resources, analyse data, deliver citizen services, and operate more efficiently. Features, availability, and functionality may vary by subscription, licence, or institutional agreement.
We may modify, improve, or discontinue features of the Services at any time. We will endeavour to provide reasonable notice for material changes that affect active users.
7. Fees and payment
Certain Services may be provided under a fee or subscription arrangement. Fees, billing terms, and renewal terms will be set out in a separate order, agreement, or invoice. Unless otherwise stated, all fees are non-refundable. You are responsible for applicable taxes and charges.
8. Intellectual property
AccessGov retains all rights, title, and interest in the Services, including software, designs, logos, trademarks, documentation, and other materials. These Terms do not grant you any licence to use our intellectual property except as necessary to use the Services in accordance with these Terms.
You retain ownership of any Content you submit through the Services. By submitting Content, you grant AccessGov a limited licence to use, host, process, and display that Content solely to provide and improve the Services for you and your Institution.
9. Confidentiality and data
Both parties agree to protect the confidentiality of any proprietary or sensitive information disclosed in connection with the Services. AccessGov will handle institutional and personal data in accordance with our Privacy Policy and any applicable data-protection laws.
Users are responsible for ensuring that any Content they submit complies with applicable laws and internal policies of their Institution.
10. Third-party services
The Services may integrate with or link to third-party products, services, or websites. AccessGov is not responsible for the availability, accuracy, content, or practices of those third-party services. Your use of third-party services is governed by their own terms and policies.
11. Termination
You may stop using the Services at any time. AccessGov may suspend or terminate your access to the Services if you violate these Terms, if required by law, or for operational reasons. Upon termination, your right to use the Services will immediately cease, and we may delete or archive your Content in accordance with our data-retention practices.
12. Disclaimers and limitation of liability
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. AccessGov does not warrant that the Services will be uninterrupted, error-free, secure, or free from harmful components.
To the maximum extent permitted by law, AccessGov and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss, arising out of or related to your use of the Services.
13. Indemnification
You agree to indemnify and hold harmless AccessGov, its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses arising out of your use of the Services, your Content, or your violation of these Terms.
14. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Nigeria.
15. Changes to terms
AccessGov may revise these Terms from time to time. We will post the updated Terms with a new effective date. Continued use of the Services after the changes take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
